NZTR Lays Charges Against Bosson And Herd
Wednesday, 15 October 2008: Herd has been charged under NZ Rule 1001 (1) (p), which relates to a "serious racing offence" and also NZ Rule 528 (2) relating to the drug testing of riders.
Bosson has also been charged under both rules for aiding and abetting Herd in both offences.
It is believed Bosson provided a urine sample for Herd.
NZ stewards opened an investigation after a tip-off led them to check the validity of one of the urine samples taken at the Te Rapa meeting.
Herd was asked to provide a urine sample but allegedly had Bosson provide a substitute sample.
It is understood the urine sample tested negative.
The rules under which Herd and Bosson have been charged read:
* 1001 (1): Every person commits a serious racing offence within the meaning of these Rules who, in New Zealand or any other country:
(p) commits any dishonest or fraudulent act connected with racing or the on-course or off-course totalisator
* 528 (2): Every rider or stablehand who, having been required by a Stipendiary Steward or Racecourse Inspector or Judicial Committee to supply a sample of his blood, breath, urine, saliva or sweat (or more than one thereof), at a time and place nominated by the Stipendiary Steward or Racecourse Inspector or Judicial Committee who refuses or fails to comply with such a request commits a breach of this Rule.
Any breach of this Rule shall be reported to the Board of Thoroughbred Racing by the Registrar of the Judicial Committee which dealt with the breach and that Board shall consider whether, in addition to any penalty imposed by the Judicial Committee the Licence or Certificate of a rider shall be cancelled or withdrawn under Rule 318(1) of these Rules.
The charges carry severe penalties including disqualification.
Details of when Bosson and Herd will be called to answer these charges have not been released but it may not be until the last week of October.
Bosson is booked to ride equal favourite Princess Coup in the $3 million W.S. Cox Plate at Moonee Valley on Saturday week.
Herd and Bosson are free to continue riding pending a hearing but have voluntarily stood down from riding at NZ meetings this week.
